05/2019 Europlex abandoned appeal based on the advice of new Senior Barrister.
Europlex Pty/Ltd became very unhappy with performed action of my lawyer Hector Ekes,
due to unreasonable demands for payment, after his firm was paid in excess of $230,000.
These funds were paid to Hector since the beginning of the case.
New Lawyers advised me that the sum was unusually high.
Also, funds have been sent to 3 different accounts. That is against the law apparently.
New Lawyers studied the proceedings which we had to get from court because Hector Ekes denied to pass them on new lawyers and demanded
another $100,000 to release documents. This is all documented.
Also, there is numerous dirty SMS from Hector Ekes demanding money.
My new senior barrister advised me after assessment of proceedings and transcripts,
that there are incredible unlogical steps executed by GARDNER EKES and back then barrister DAMIAN ALLEN - from State Chambers.
They said if everything was done properly we had great prospects. Based on the recommendations
we abandoned the appeal because it had no prospect.
Major error/or intentional step by barrister pointed by the new team.
THEY HAVE NOT LODGED MY AFFIDAVITS IN COURT!!! THEREFORE OUR DEFENCE COULD NOT BE HEARD IN COURT.
NOT ONE INVOICED ISSUED FOR $230,000
FUNDS PAID TO 3 DIFFERENT BANK ACCOUNTS
NOT RESPONDING TO OUR NEW LAWYERS DEMANDS
MISLEADING INFORMATION AND LEADING US TO FINANCIAL RUIN!
The cherry on top was a phone call from one of the owners of apartments telling us that SAIF HAYEK, UNIQUE LIVING OWNER told her that
he knew my previous lawyer and we could never win.
My Intentions is to expose this case to the public. It is so much more to express.
We have a strong feeling that our lawyers collaborated with Hayek, even dumbest lawyer would not take those steps in court.
Our business Europlex has been in operation for 16 years with no debts, infringements whatsoever. As well our personal record is superb.
Therefore it is hard to overcome the fact that we have lost money in project etc and as well we have been enormously misled by Lawyers.
There is a proven record of misconduct of Hector Ekes with Law society. It comes to me now that we have been dealing with a colourful lawyer.
