My Experience With Bayside Solicitors - Alleged Professional Misconduct Complaints filed to the NSW Legal Service Commissioner
In October of 2022 my father passed away, he was 93 years of age dying of cancer.
11 days before his death Bayside Solicitors commenced divorce proceedings in an attempt to separate my father from my then 85 year old mother.
When my father died we learned that his will had been changed and his entire estate was willed to my brother who became the executor of his estate.
The deeds of my mother and fathers marital home were also changed without my mother’s knowledge or consent from joint tenants to tenants in common.
Following my father's death Bayside Solicitors sent letters to my elderly mother threatening to force the sale of her home.
My mother had no option other than to commence proceedings in the NSW Supreme Court to seek orders to allow her to live out the duration of her life in peace and in her own home.
Despite being a non-party to the proceedings Bayside Solicitors served an unjust subpoena upon me demanding access to my bank statements, tax returns and other privileged information which I vehemently objected to.
The subpoena was nothing more than a fishing expedition to invade my privacy and gain access to privileged information.
Bayside Solicitors were already in possession of my mother’s bank statements and affidavits which proved that no joint financial position was ever held between my mother and myself but continued to vigorously pursue the unjust subpoena.
Bayside Solicitors attempted to prove to the court that my mother was mentally unsound to make decisions to instruct her lawyers which failed.
Our family has suffered hundreds of thousands of dollars in financial losses as a result of the actions taken by Bayside Solicitors.
My experience with Bayside Solicitors was both uninvited and extremely distasteful causing substantial financial losses being subpoenaed into proceedings that I was not a party to.
The principle case ran up excessive legal costs leaving my elderly mother with no alternative other then to accept an out of court settlement costing her hundreds of thousands of dollars of her life savings to avoid the risk of losing her home.
Documented alleged professional misconduct complaints have been filed with the NSW Legal Services Commissioner.
